The
Department of Consumers of the
Ministry of Economy revoked the
authorization for the sale of tour
packages to the company Clubes Colón
S.A, authorities reported. According
to the ministry, this company must
stop operations and present to the
authorities a final settlement of all
pending agreements with its
clients. The
settlement allows all active customers
to receive a refund of the money they
have paid for tourism services that
have not yet taken place. Although
the company filed an appeal against
the decision of the authorities, it
was rejected by the ministry. Authorities
said they concluded with their final
decision to stop the Clubes Colón
S.A.'s sale of tourism services after
an investigation that began in 2020. It was
during the company operations review,
authorities detected a series of
inconsistencies that justify revoking
their sale of tourism products.
Authorities also filed a criminal complaint at the Public Ministry for alleged fraud to the detriment of their clients. The statement included the main company Clubes Colón S.A., and two other companies of the same corporation, Agencia de Viajes Colón S.A., WV Distribuidora Colón S.A.
No one of those companies are authorized to sell any type of travel or tour services, the ministry said in its statement.
The license withdrawn from these companies has to do with operations related to the sale of reservations for tourist packages or travel plans such as transportation, flight tickets, hotel reservations and tours among others.
According to the ministry, to file the criminal complaint, the sensitive data of the company was analyzed. They looked at their financial statements, lack of tax payments to the General Directorate of Taxation, lack of payments to Social Security and complaints filed by clients before the National Consumer Commission, among other matters.
Law No. 7472 "Promotion of Competition and Effective Consumer Protection," regulates companies that operate on selling products or services to be used within the scheduled time. For example flight tickets. The law establishes that only companies authorized by the Ministry of Economy are allowed to sell future use of products or services.
Authorities call on the public to report any suspicion of companies that are selling tourist services without authorization by calling the ministry line 2549-1400 or emailing at consumer@meic.go.cr
